Terms of use

These terms of use (the “Terms”) govern your access to and use of swissdiscover.com (the “Site”) and the services offered through it. By using the Site you accept these Terms. If you do not agree, please do not use the Site.

The Site is operated by Shelduck Production Sàrl, a Swiss limited liability company (Société à responsabilité limitée) registered with the Commercial Register of the Canton of Valais under number CHE-257.352.408, with registered office at c/o Fidaly SA, Rue Notre-Dame-des-Marais 1, 3960 Sierre, Switzerland.

You may use the Site for personal, non-commercial purposes. You agree not to misuse the Site, including (without limitation):

• attempting to gain unauthorised access to any part of the Site or its underlying systems;
• interfering with the Site's operation, including via automated scraping, denial-of-service or similar techniques;
• using the Site to upload or transmit unlawful, harmful, infringing or misleading content;
• reverse-engineering, decompiling or extracting source code, except as permitted by applicable law.

The content on the Site — including curated places, partner information, blog articles, prices and bookable experiences — is provided for personal and informational purposes only. We make reasonable efforts to keep the content accurate and up to date, but we give no warranty, express or implied, as to its accuracy, completeness, timeliness or fitness for any particular purpose.

The Site may be modified, suspended or discontinued in whole or in part at any time, with or without notice. We do not guarantee uninterrupted, error-free or secure operation.

To the fullest extent permitted by Swiss law, Shelduck Production Sàrl, its managers, employees and partners disclaim any liability for direct, indirect, incidental, consequential or other damages arising out of or in connection with your access to or use of the Site, including damages caused by errors, omissions, viruses, unauthorised access, or unavailability of the Site.

Nothing in these Terms limits any liability that cannot be excluded under Swiss law, such as for gross negligence or intentional misconduct.

All content published on the Site — including text, images, videos, logos, the map design, the GeoGuesser game and the underlying software — is protected by copyright and other intellectual property rights, and remains the exclusive property of Shelduck Production Sàrl or its licensors.

You may view and print pages of the Site for personal use, provided the source is acknowledged. Any other reproduction, distribution, public communication, modification, embedding or framing requires our prior written consent.

The Site includes content and services provided by third parties, for example map tiles by Swisstopo, embedded videos from YouTube, bookable experiences from Viator, outbound links to Hotels.com, and products sold through Shopify. We do not control these services and assume no responsibility for their content, availability, accuracy, legality or terms.

When you book, purchase or otherwise interact with a third-party service from the Site, that interaction is governed by the third party's own terms and privacy policy. Outbound hotel links may contain affiliate tracking parameters; see our Privacy Policy for details.

The shop is operated through Shopify. Orders placed via the shop are subject to the order confirmation you receive, Shopify's terms and any specific terms shown at checkout. Prices are shown in Swiss francs (CHF) unless stated otherwise and include applicable VAT where required.

The GeoGuesser game is offered for entertainment purposes only. Scores are calculated automatically based on your guesses and the time taken. We may remove scores or accounts that we reasonably consider abusive, automated or in breach of these Terms.

If you submit a username and email address with a score, you authorise us to display that username on the public leaderboard.

Access to the SwissDiscover CMS (at /cms) is reserved for partner companies and authorised users. CMS users are responsible for keeping their credentials secret and for all actions taken under their account.

We may update these Terms from time to time. The version published on the Site at the time you use it is the version that applies. Material changes will be highlighted on the Site.

These Terms and your use of the Site are governed by Swiss law, excluding its conflict-of-laws rules and the United Nations Convention on Contracts for the International Sale of Goods (CISG).

Subject to any mandatory consumer-protection rules, the courts of Sierre, Canton of Valais, Switzerland, shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms or the Site.
